End User License Agreement

1. Introduction

This End User License Agreement ("Agreement") is a legal agreement between you and TransformPix ("TransformPix," "we," "us," or "our") for the use of the TransformPix mobile application ("App") and related services. By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement, our Terms of Service, and our Privacy Policy. If you do not agree to these terms, do not use the App.

2. License Grant

Subject to the terms of this Agreement, TransformPix grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on a mobile device owned or controlled by you.

3. Restrictions

You agree not to:

  • Copy, modify, or create derivative works of the App;
  • Distribute, transfer, sublicense, lease, lend, or rent the App to any third party;
  • Reverse engineer, decompile, or disassemble the App;
  • Use the App in any unlawful manner or for any unlawful purpose;
  • Use the App to infringe upon the rights of others.

4. Ownership

The App is licensed, not sold, to you. TransformPix and its licensors retain all right, title, and interest in and to the App, including all intellectual property rights. You acknowledge that no title to the intellectual property in the App is transferred to you.

5. Updates

TransformPix may from time to time provide updates to the App. These updates may include bug fixes, feature enhancements, or improvements. You agree that TransformPix may automatically update the App without prior notice to you.

6. Termination

This Agreement is effective until terminated by you or TransformPix. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any term(s) of this Agreement. Upon termination, you must cease all use of the App and delete all copies from your mobile device.

7. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TRANSFORMPIX DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

IN NO EVENT WILL TRANSFORMPIX, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE APP, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice or conflict of law provision or rule.
